Under the Trade Marks Act, 1999, and the Trade Marks Rules, 2003, an application for trademark registration is filed with the Trade Marks Registry of the Government of India. The Learned Examiner of the Trade Marks Registry, Government of India, examines the application for trademark registration, and if all of the legal parameters for trademark registration are met, the subject trademark is accepted and published in the Trade Mark Journal. A registered trademark is valid for ten years and must be renewed every ten years after that.
